Terms of Use for ALFRED.energy app
The Most Important Information in This Agreement – Simply and Straightforward:
The Alfred application allows you to remotely manage your photovoltaic power plant. It ensures its health, optimal settings, and maximum financial savings. For Alfred to perform these tasks reliably, you must provide a quality internet connection.
Optimal functioning of Alfred also requires that no other tools for managing your photovoltaic system are used. Such interventions could distort the output data of the power plant and reduce the quality of Alfred’s services.
Alfred will notify you if your photovoltaic system is not functioning as it should. However, the technical condition of the photovoltaic power plant and its maintenance remain the full responsibility of your contractual partner—usually the company that installed your photovoltaic system.
The price for Alfred’s services is set out in the price list on the website https://alfred.energy/. If we update the price or Terms of Use in the future, we will always notify you in advance, either by email or directly in the ALFRED.energy application.
The development and operation of Alfred are managed by SOLSOL s.r.o., the largest distributor of photovoltaic power plants in the Czech Republic. If any damage occurs to your property directly related to the management of your photovoltaic system through Alfred, SOLSOL may assume financial responsibility for the damage only up to the residual value of the inverter in use.
Introduction:
These Terms of Use for the ALFRED.energy software (hereinafter referred to as „Terms of Use“) constitute an agreement between you as the user („you“) and SOLSOL s.r.o., Company ID: 293 60 391, headquartered at Zeleného 652/9, Brno, Postal Code 616 00, registered in the Commercial Register maintained by the Regional Court in Brno, Section C, Insert 75143, as the operator („we“ or „SOLSOL“) of the ALFRED.energy service („Alfred“). By agreeing to these Terms of Use, you agree to be bound by them.
The Terms of Use are valid and effective in their current form published on the website https://alfred.energy/ and in the ALFRED.energy mobile application. We reserve the right to amend these Terms of Use at any time without providing a reason. You will be informed of any changes or additions to the Terms of Use before they take effect by publishing the updated version on the website https://alfred.energy/ and simultaneously in the ALFRED.energy mobile application.
We recommend regularly checking the Terms of Use because continuing to use Alfred confirms your agreement with any updates to the Terms. If you do not agree with these Terms of Use or any of their provisions, you will no longer be able to use or access Alfred’s services.
Some of our services may be subject to additional terms or requirements. These additional terms are available with the respective services. If you use these services, the additional terms become part of the contractual agreement between you and SOLSOL. In the event of a conflict between these Terms of Use and the additional terms, the additional terms will prevail.
Registration of Account and Access to the Service
By accepting these Terms of Use, a contractual relationship is established, granting you access to Alfred. Alfred is accessible only to registered users who meet the technical prerequisites for connecting their photovoltaic power plant (hereinafter referred to as „FVE“) to Alfred’s interface and fulfill the other conditions stated in these Terms of Use.
You may register only an FVE that you own or are authorized to use based on another legal title (e.g., lease agreement). If you own or use multiple FVEs, Alfred will manage all your FVEs connected to it.
During registration, you must provide complete, accurate, and truthful information and maintain its accuracy throughout the term of our contractual relationship. Any changes to your information must be promptly updated directly in the ALFRED.energy application.
In some cases, part of the registration process may be completed by your installation company, such as adding technical information about the installed capacity of the FVE, its location, orientation and tilt of the photovoltaic panels, or battery capacity. It is your responsibility to carefully review this information, as you are ultimately accountable for its accuracy.
Account Security and Access Credentials
When choosing a password, we recommend selecting a sufficiently strong password and taking appropriate measures to protect it to prevent theft or unauthorized access and misuse by third parties. In this regard, we strongly advise you to keep your login details confidential and not disclose them to unauthorized persons. If you share your login details with a third party, you risk allowing such a person to make changes to your FVE settings, Alfred’s services, or preferences related to your FVE without your knowledge and consent.
After registering your account, you may grant access rights to your account to a third party. However, please note that any activity performed under your account credentials is considered your responsibility, and you assume full liability for all actions performed using your login details.
If you become aware that your access credentials for Alfred have been misused, you are obliged to notify us immediately by email at alfred@alfred.energy, so we can help minimize the risk of damage. Similarly, we ask you to inform us if you learn that the credentials of a third party have been misused or disclosed in any way.
Terms of Use
Alfred is here to serve you efficiently and reliably. Specifically, it provides services for the remote management of your FVE to ensure its long-term health, efficiency, and improved economic return. Alfred enables you to:
- Monitor and control your FVE;
- Supervise its operation and maximize the efficient use of generated electricity;
- Diagnose issues with your FVE;
- Manage the efficient purchase and sale of electricity through your energy trader.
For optimal results with Alfred, it is essential not to use any other tools for managing your FVE, whether automated or manual. Any such interference may distort your FVE’s output data and reduce the quality of the services Alfred provides.
Alfred is exclusively at your service. By accepting these Terms of Use, you agree to use Alfred and its components solely for your own needs. Specifically, it is prohibited to sell, rent, distribute, copy, or share Alfred or its data with third parties. Unauthorized interventions in Alfred’s content, whether technical or substantive, are also prohibited. Any infringement of intellectual property rights beyond what is granted under these Terms of Use is strictly prohibited. Unauthorized use constitutes a violation of our rights and may also infringe the rights of third parties whose data or works are part of Alfred’s content.
Improper use of Alfred includes any use contrary to these Terms of Use, third-party conditions, or applicable laws.
Handling Your Data
We are authorized to share information about your FVE, user account, and other data (including personal data) with third parties only under the following circumstances:
- As required or permitted by law;
- By court order or decision of a public authority;
- To protect our legitimate interests;
- To selected contractual partners, such as manufacturers or suppliers of individual FVE components, our installation and service partners, insurers, and electricity distributors;
- For data processing in compliance with GDPR;
- When sharing is in your interest and necessary for Alfred’s proper operation;
- When sharing is required for the administration of your payment for services.
Details about how we handle your personal data and FVE data are outlined in our Privacy Policy.
Pricing for Alfred’s Services
The price for Alfred’s services is determined by the pricing list („Price List“), which also specifies the validity period of the list. Any changes to the Price List will be announced in advance on the service’s website https://alfred.energy/, in the ALFRED.energy application, or through other electronic communication methods. Unless otherwise agreed, the price for Alfred’s services is payable in CZK or EUR.
During initial registration, you may use a discount coupon, if provided by the entity that installed your FVE, for up to 100% of the service price for a given period. During the term of the contractual relationship, we allow you to switch between different subscription plans offering various types of services. Further details are provided on the service website https://alfred.energy/.
When first registering, you will have access to a trial mode under the conditions specified for the period. The trial mode is free of charge.
If you are a consumer, before ordering Alfred, you will be informed about the price, applicable taxes and fees, and the duration of the service. As a consumer, you have the right to withdraw from the contract within 14 days of its conclusion unless you provide explicit voluntary consent for the service to commence before the 14-day withdrawal period expires. In such a case, your right to withdraw within the 14-day period is waived.
Licensing Agreement
We grant you a non-exclusive, non-transferable right to use the Alfred software, as follows:
- For the duration of the contractual relationship established by these Terms of Use;
- Globally;
- In accordance with the purposes outlined in the Terms of Use.
This license is granted solely for uses arising from these Terms of Use, generally binding Czech laws, or uses necessary to achieve the intended purpose of Alfred. License rights may not be transferred, sublicensed, or otherwise encumbered, nor can they be transferred to third parties.
The licensing fee is included in the price for Alfred’s services.
Responsibility for Improper Use
If you violate these Terms of Use or use Alfred improperly, your account will be permanently blocked, including your IP address, with no possibility of reactivation. Additionally, you will forfeit any claim to a proportional refund for the unused subscription period. This forfeiture will serve as a contractual penalty for breaching these Terms.
Liability for Damage
Alfred is provided „as-is“ without any warranties. SOLSOL is not liable for the completeness, accuracy, reliability, or functionality of the software or data contained within it. However, in cases where Czech law mandates liability for damages, SOLSOL’s responsibility is limited to the residual value of your inverter.
Intellectual Property Rights
All content in Alfred is protected by copyright. Access to and use of Alfred do not grant you any intellectual property rights beyond those specified in these Terms of Use. You are not authorized to use Alfred’s names or logos without explicit permission.
Termination of the Contractual Relationship
Either party may terminate the contractual relationship established by these Terms of Use at any time, without providing a reason. Unless stated otherwise in these Terms of Use, the relationship ends on the last day of the calendar month in which the notice is delivered to the other party. Notifications should be sent:
- To you at the email address associated with your ALFRED.energy account.
- To us at the email address provided below.
If we terminate the relationship due to your default or another breach of these Terms of Use or applicable laws, the relationship terminates immediately upon the notice taking effect, which occurs on the date the notice is delivered to you as described above.
Upon termination of the relationship, we reserve the right to block and revoke access to your account.
We are also entitled to cancel your account if it remains inactive for six months. Inactivity is defined as a lack of response to our prompts related to using the service (e.g., if we request an action via email to confirm active use and you fail to act for six months) or if the FVE linked to your account is inactive (e.g., disconnected or decommissioned). In such cases, we are entitled to cancel all accounts linked to the specific FVE. Terminating the last user account associated with an FVE also terminates the contractual relationship and your obligation to pay for Alfred’s services related to that FVE.
However, the termination of the contractual relationship does not relieve you of your obligation to pay for Alfred’s services provided during the period when they were used but unpaid.
Viruses
Please acknowledge that you use Alfred’s services entirely at your own risk. You are responsible for ensuring the security of your information technology, computer programs, and platform for accessing Alfred and should use appropriate antivirus software. We are not liable for viruses or other technologically harmful material that may be transmitted while using Alfred.
You must not misuse Alfred by intentionally introducing viruses, trojans, or other malicious materials, nor may you harm or exploit Alfred in any way. You are obligated to take reasonable security measures to ensure Alfred is not compromised by harmful materials. At SOLSOL, we strive to make Alfred reliable, transparent, and free of harmful programs. If we detect any breach of the program, we will make every effort to rectify it as quickly as possible.
For maximum prevention and safe use, we recommend that users regularly update Alfred whenever a new version with security patches is released.
Intellectual Property Rights
All content in Alfred is protected by copyright. Using Alfred does not grant you any intellectual property rights beyond the license outlined in these Terms of Use. You are not authorized to use the names or logos of Alfred/ALFRED.energy or SOLSOL without explicit permission. These names and logos remain the exclusive property of SOLSOL.
Using Alfred must not be interpreted as granting any license or right to use trademarks or trade names displayed in the software, except as explicitly permitted by these Terms of Use.
Privacy Policy
SOLSOL’s Privacy Policy outlines the conditions under which we process personal data you provide or data we collect and store. By using Alfred, you consent to the processing of your personal data and are responsible for ensuring its accuracy and currency.
The Privacy Policy is available:
- On the service website at https://alfred.energy/
- In the ALFRED.energy mobile application.
Governing Law
These Terms of Use and the contractual relationship established by them are governed by the laws of the Czech Republic. In case of legal disputes, the exclusive local jurisdiction is the court in the district where SOLSOL is headquartered.
If the contractual relationship contains an international element, the parties agree that the relationship is governed by Czech law. This does not affect consumer rights arising from generally binding legal regulations.
If any obligation or provision of these Terms of Use (including any paragraph, article, sentence, or word) is or becomes invalid, unenforceable, or void, this shall not affect the remaining provisions of these Terms of Use. The invalid, unenforceable, or void provision will be replaced by a new valid and enforceable provision that most closely reflects the intent of the original provision.
